Tuvalu opposition lawyer sees big implications in court case

3:58 pm on 4 July 2003

The lawyer representing Tuvalu's opposition in its battle with the Prime Minister says the case could lead to a change of government.

The opposition party is angry that the prime minister, Saufatu Sapoaga, has not called parliament following the election of a new speaker.

James Duckworth, who is acting for the opposition, says a declaration is sought that the Governor-General, Sir Tomasi Puapua, can and must call a session of parliament.

Mr Duckworth says the Chief Justice, Justice Gordon Ward, is expected to decide in the next 14 days when the case will be heard.

He says the case has major constitutional implications.

"It's very rare in Tuvalu to have any case of constitutional implications like this. I think this is the first, to my knowledge, that has ever taken place in Tuvalu with this kind of implications and it is certainly the first that could actually result in a potential change of government."
