Solomons acquittal in Australian killing case to go to appeal

4:05 pm on 21 April 2004

The Solomon Islands Office of Public Prosecution has served a notice of appeal against the acquittal of two men suspected of killing Australian missionary worker, Lance Gersbach, in May last year.

High Court judge, Justice John Brown, had acquitted the two men on the grounds that the prosecution had not tendered in court sufficient evidence to convict the two.

Solomon Islands radio says an officer of the High Court, Bobby Feratelia, has confirmed that the court received the notice of appeal last Friday, but says the Court of Appeal is yet to set a date for the hearing.
