The Executive Director of Fiji's Citizen Constitutional Forum has welcomed a High Court ruling which allows consensual sex between people of the same sex in private.
Despite outrage expressed by the Prime Minister and the Council of Churches over the decision, Reverend Akuila Yabaki has described the ruling as a triumph.
The ruling was given by Justice Gerard Winter who quashed a conviction and sentence against an Australian tourist and a local, imprisoned in April for homosexual acts.
Justice Winter ruled that sections of Fiji's Penal Code were inconsistent with provisions of the constitution and therefore invalid.
Reverend Yabaki says the constitution has been recognised as the supreme law of the land.
"A triumph for the constitution which has equality before the law for different sexual orientation. So it accepts diversity. There's also the privacy which also is a constitutional right. So that is also sustained. There is actually justice for people who are actually voiceless in society. There's an issue of justice there which political leaders should take account of."
