The American Samoa Senate is taking the Manager of the Territorial Office for Fiscal Reform to court for contempt of the Senate.
At the weekend the Senate unanimously approved a resolution finding Jack Kachmarik in contempt for failing to comply with a subpoena for financial records of the government.
The resolution authorises the filing of a contempt charge against the manager and asks him to produce the requested records.
The Senate will also ask the court to order the Attorney General to enforce the production of the financial information.
Mr Kachmarik told the Senate last week he was advised by the Attorney General's Office and Governor's Office not to produce the records until the Senate Investigative Committee which supboened them pays 31-thousand US dollars for copies.
He said the committee could also view the records at his office or provide their own paper and copying machine.
