The lawyer for the Naitasiri provincial chief who was released by the Fiji Court of Appeal this week will ask the director of public prosecutions to drop the mutiny charges against him.
The Appeal Court quashed Ratu Inoke Takiveikata's conviction and life sentence on the grounds of perceived bias by the trial judge, Justice Anthony Gates, and ordered that he be tried again.
But Takiveikata's lawyer, Davnesh Sharma, has told the Fiji Times they will be making submissions to the DPP to let the matter rest.
Mr Sharma says Takiveikata has already served 31 months in prison and they believe the proceedings should end.
The chief had been convicted on three counts of inciting the November 2000 mutiny and one count of aiding soldiers in the act of mutiny.
Takiveikata is a founding member of the ousted SDL party, its former vice president and lifetime patron and at the time of his jailing was a Qarase government senator.
