State lawyers in Fiji have begun moves to strike out the High Court case brought by the deposed prime minister, Laisenia Qarase, challenging the overthrow of his government in the military takeover last December.
The Daily Post reports that yesterday Mr Qarase's lawyer, Tevita Fa, was served with a summons calling on all parties to meet in chambers and hear an application to strike out Commodore Bainimarama and the Fiji Military Forces as defendants.
The two are the first and second defendants while the state and the interim attorney general are the third and fourth defendants.
The grounds for the application to strike out the first two defendants are that their conduct is not susceptible to challenge because of the president's promulgation of the Immunity Decree No 3 of 2007.
Mr Fa says if the solicitor general succeeds in his application to strike out Commodore Bainimarama and the military as defendants, it would see an end to the law suit.
Ministers of the SDL government and the party are also plaintiffs in the High Court case.
