Fiji solicitor general asks court to throw out Hannah case

Fiji's Solicitor General has applied for the court action involving Evan Hannah to be thrown out, on the basis that the court order to stop the expulsion has lapsed.

Lawyers acting on behalf of Mr Hannah tried to stop the expulsion through court action after he was arrested last Thursday but the interim government proceeded with his removal a day later.

Our correspondent Matelita Ragogo says the case has been adjourned until next Thursday.

"The solicitor General, Christopher Pryde, has applied for a strike-out action against this case. His main argument being that the court order that was given then, the habeas corpus lapsed when Evan Hannah was no longer in detention. So there's really no point in continuing this case. But John Apted came back and said that he need the responses, he wanted questions that were asked, regarding the legality of Evan Hannah's detention answered by the respective respondents."
