The lawyer for a New Zealand man accused of plotting against Fiji's interim Prime Minister today begins his High Court battle to have the case thrown out.

Ballu Khan and ten others have been charged with conspiracy to kill Commodore Frank Bainimarama, and other cabinet members.

But his lawyer will today ask Fiji's High Court to dismiss the three charges against him.

Peter Williams QC says the state has destroyed relevant documents, and the mainly military officials have failed to disclose evidence to Mr Khan.
