Delay to trial into wrongful death of American Samoa baby

9:00 am on 28 August 2009

The federal trial in Honolulu in the civil suit brought by the parents of baby Michael Futi against the US government for wrongful death has been postponed until next year.

The two week old baby died in February last year while detained by Customs & Border Protection at a customs room at the Honolulu International Airport.

The non-jury trial was set to commence in November but court documents show it has been continued to April next year.

Federal electronic court records do not show the reasons for postponing the trial til next year.
