The Supreme Court in Samoa will hear a re-trial next month of a doctor facing one count of indecent assault.
The doctor was acquitted on the charge a few years ago but state lawyers prosecuting the case at the time had appealed against the decision.
The court of appeal in 2007 had ruled for a retrial because there is a case to answer.
The names of the accused and the complainant are suppressed including the details of the case until the end of the retrial.
The retrial was called for last month however defence lawyers applied for a stay of proceedings because the matter dragged on for years.
But the presiding judge dismissed the application.
The case will now start on July 2nd.
