The American Samoa Government wants the courts to limit the scope of claims in an age discrimination lawsuit filed against it by the US Equal Employment Opportunity Commission.
The lawsuit, filed in Honolulu last year, claims two Human Resources workers were involuntarily re-assigned from their roles in an attempt to push them into retirement.
The Commissioner says this amounts to age discrimination.
This week, the territorial government filed a motion for a partial summary judgment seeking that the court limit the scope of the Commission's case.
It says the Commission seeks to use discovery in litigation to uncover and assert potential discrimination claims through the entire American Samoa Government and its nearly 5,000 staff.
Its lawyers say the Commission is not permitted to use discovery as a fishing expedition to uncover other claims.
