The new Solomons Islands police commissioner remains on official leave while an investigation continues into his motor vehicle collision in the capital Honiara in September.
Peter Aoraunisaka has been off duty since the crash, which occurred shortly after his appointment to the top police post.
Police say Mr Aoraunisaka was the only person involved in the incident.
But civil society groups have claimed it was orchestrated by elements of government in order to discredit him and install a preferred candidate, Walter Kola, who was suspended earlier this year over allegations of corruption.
A spokesperson for the acting police commissioner, Anika Nausi, says a decision is yet to be made as to whether Mr Aoraunisaka will face charges over the collision.
But she says whether he will be sworn in as commissioner is a matter for the prime minister and governor general.
The governor general, Sir Frank Kabui, has referred the appointment back to the prime minister's office on the grounds of age.
Sir Frank's private secretary, Nigel Maezama, says the governor general's office has not received any further advice on the matter.
