Men walk free in Samoa manslaughter appeal

Samoa's Court of Appeal has quashed the manslaughter verdict of two men who were initially charged with murder.

The appellants, Loi Apa'au and Talitonu Lei'ataua, had been jointly charged, and found guilty of manslaughter by the assessors.

A third man, Elisita Peniata, was acquitted by the assessors.

The incident occurred at a party in October last year, with one death from an alleged assault.

The Court of Appeal ruled that if it cannot be excluded the victim's death had been directly or indirectly caused by a punch from the third man - Mr Peniata - then neither of the appellants could properly be found guilty of manslaughter.
