A 63 year Samoan woman is to face trial for the murder of a child after her lawyer's application for the charge to be quashed was dismissed.
Maota Ah Ta has been charged over an incident 42 years ago for which she has been accused of strangling a baby to death.
Two of the prosecution witnesses have died but prosecution lawyers have told the court that other witnesses living overseas are willing to give evidence in support of the police case.
The defendant was 21 years old at the time of the alleged incident.
She lives in Australia with her family but she has returned to Samoa for the case.
A new hearing date is to be set next week.
