Dotcom fights legality of search warrant

12:22 pm on 2 May 2012

Megaupload website co-founder Kim Dotcom is fighting the legality of a search warrant used to seize digital data from his home.

Investigators used the warrant to seize evidence for use in the case against Mr Dotcom, who is facing extradition to the United States to face charges of internet piracy relating to the file-sharing website.

Mr Dotcom is seeking a judicial review of the search warrant, saying it was unlawful because it was too broad.

His lawyer, Paul Davison, says investigators should have been able to seize only items relevant to the case, but instead the warrant allowed them to take anything that could store digital data.

Mr Davison says that resulted in items being taken that are irrelevant to the case, including security camera footage and home videos.

He says prosecutors have agreed that none of the items will be taken overseas until the review is complete.

The case will be heard at the High Court in Auckland on 22 and 23 May.
