US judge to decide on Megaupload charges

6:17 am on 30 July 2012

A judge in the United States is expected to decide in a matter of days whether to dismiss charges against the Megaupload file-sharing company founded by Kim Dotcom.

Megaupload was indicted this year on charges relating to copyright infringement and the US authorities are seeking to have Mr Dotcom extradited from New Zealand.

A lawyer for Megaupload, Ira Rothken, says a hearing was held in a US federal court in Virginia at the weekend.

Mr Rothken says he argued the US has no jurisdiction over the company because it is based in Hong Kong and it has no presence in the country except for data stored on leased servers.

He says the judge should return a written decision on the case soon and is confident he will rule in Megaupload's favour.
