Police have withdrawn charges against one of two men accused over an attack on the sole police officer in Kawhia in Waikato last month.
Jack Maikuku, 49, was charged with aggravated assault and assault with intent to injure.
Those charges were withdrawn in the Te Awamutu District Court on Monday morning.
Constable Perry Griffin was attacked in full view of a large crowd as he tried to arrest a man at the town's wharf.
Mr Maikuku's lawyer, Roger Laybourn, says his client is relieved but the charges should never have been laid.
He says when police looked at recordings taken by the public at the time, they found Mr Maikuku could not have been involved in the assault.
