Anti-abortion group seeks to have judgment enforced

The High Court in Wellington has been asked to make orders to clear up any confusion the Abortion Supervisory Committee has about its duties under the abortion legislation.

Right To Life says despite a ruling last year which questioned the legality of some abortions in New Zealand, the committee continues to operate on a business as usual basis.

It says despite serious reservations being raised about the lawfulness of abortion, the committee has done nothing to address that point.

In his judgment last year, Justice Miller suggested that the committee advise certifying consultants to keep records of their diagnoses in signing off abortions and the severity of the condition involved.

However, Right To Life's lawyers say that is still not being done and there is a need for declarations from the court to clear up any misunderstandings the committee has about its powers.

The committee's lawyers told the court it was aware of its broader powers as defined in the legislation and there was no need for orders.

The court has reserved its decision.
