Court slashes Switched on Gardener man's sentence

The Court of Appeal has slashed the sentence given to one of the men in the Switched on Gardener case, saying it was manifestly excessive.

Bobby Dingemans was one of 10 employees at the chain of indoor gardening supply stores who was convicted earlier this year of supplying materials for cultivating cannibas.

He was sentenced to two and a half years in jail but the Court of Appeal has overturned that and he will now serve five months' home detention instead.

In the court's judgment, Justice Harrison said that, unlike many of the other offenders, Dingemans was not convicted of dealing or cultivating for his own financial benefit.

He says the new sentence takes into account the fact that Dingemans has already served five months in jail and will not be eligible for parole once on home detention.
