Air NZ employee was unjustifiably dismissed rules Authority

A court decision has found a former Air New Zealand flight attendant crew was unjustifiably dismissed by the airline, which believed she had misused her sick leave.

Gina Kensington asked the Employment Relations Authority to order her reinstatement.

She says she took the sick leave to care for her ill sister in March, but Air New Zealand demanded she release personal information to prove it.

The authority had earlier ordered Ms Kensington hand over bank records and copies of Facebook pages to verify whether she was misusing sick leave.

The authority's decision states Air New Zealand made a full and fair investigation.

However, it states the airline could not reasonably conclude that Ms Kensington was being untruthful in her claims, and found her dismissal unjustified.

A decision on her reinstatement has yet to be decided, with the authority ruling that further mediation is needed.
