A naval rating charged with assaulting a man who later died is still on duty.
Grenville McFarland is accused of hitting Tarun Asthana in downtown Auckland last Saturday.
Mr Asthana was punched once and fell to the ground, striking his head on the pavement. He died after two days on life support.
Mr McFarland appeared in the Auckland District Court on the same day charged with assault.
But the police say he will face a more serious charge at a later date.
The Navy says all of Mr McFarland's bail conditions are being met and he is still carrying out his duties.
The Navy said on the day of the court appearance that it was supporting the police investigation.
