A retired Wellington accountant who successfully sought a prosecution against outgoing ACT leader John Banks is now seeking costs from the Government.

Graham McCready argued in the Auckland District Court in late 2013 that Mr Banks should be prosecuted on a charge of making a false electoral return. The court ruled in his favour.

Mr McCready says he now wants the Government to pay his costs of between $10,000 and $20,000.

He says he did the work in the public interest after the police didn't prosecute John Banks under the Local Electoral Act.

Solicitor-General Michael Heron took over the case against Mr Banks, but Mr McCready says he incurred costs up to that point. His application is due to be filed on Wednesday.

John Banks will stand trial in May.
