No charges over Auckland death

No one will be charged over the death of a young man shot in a West Auckland drive after himself shooting another young man in the throat.

Allen George Lum, 41, on Tuesday pleaded guilty to unlawful possession of a firearm and intentional damage when he appeared in the Waitakere District Court. However, he will not be charged over the death of Joshua Wayne Roach.

The police withdrew a firearms charge against his son, Trae Lum, who is 18.

The Lum's lawyer, Murray Gibson, told the court 23-year-old Mr Roach had been waving a gun around as he argued about their shared driveway.

When Allen Lum returned to his house, Mr Roach, who was angry about his car window being smashed, shot Ricky Lum, wounding him in the throat.

Allen Lum then fatally shot Mr Roach but police accepted he was acting in self-defence and to protect his two sons, the court was told.

Allen Lum will be sentenced on the other charges in October.
