Repeat drink-driver fails in bid

A repeat drink-driver has failed in his bid to have his latest conviction overturned, despite arguing he had only been driving because he felt threatened by his son.

Douglas Clinton Brown, who had been sentenced to a year in prison, appeared at the High Court in Auckland today in a bid to quash his conviction

He told Justice Fogarty he had used a neighbour's car to get away from his son and make his way to the nearest police station.

However, he conceded that he drove several kilometres and did not stop to get help along the way.

Justice Fogarty said such circumstances did not reach the threshold for a defence of compulsion.
