The mother of an alleged victim of sexual attack at a Taranaki party has told the High Court in New Plymouth that her daughter could barely stand and smelt of vomit when she returned home.
Two teens, who were 18-year-old New Plymouth High School students at the time, face a total of seven charges involving a 17-year-old girl.
The defence claims any sexual activity between the pair and the complainant was consensual, while the Crown argues she was too drunk to consent.
The complainant's mother told the court today she was woken about 11.30pm on 11 October last year and was shocked to find her daughter at the door. She said the girl had no shoes on and had to hold on to the door frame to steady herself.
The complainant's recollection of events was challenged today.
Susan Hughes, QC, queried how she could say she had no memory from 8pm on the night of the alleged offending but told a doctor the following day that she had been drinking until 10.30pm.
Ms Hughes also noted that, in a text message the following day, the girl said the accused had not used condoms, despite claiming that she had no memory of the encounter.
