Women given permission to take eviction battle to appeal

Three Lower Hutt women fighting to avoid being evicted from their Housing New Zealand homes have been granted leave to take a case to the Court of Appeal.

In March last year, Housing New Zealand issued 90-day eviction notices against the women after a neighbour in the suburb of Pomare said she had been terrorised by their partners who were members of the Mongrel Mob gang.

The tenants took a case to the Tenancy Tribunal claiming the eviction notices were discriminatory, but the tribunal upheld Housing New Zealand's right to end the tenancies.

Similar decisions were given by the District and High Courts.

However, in a decision released on Thursday, the Court of Appeal has indicated it will consider several matters, including whether or not a 90-day eviction notice based on unlawful discrimination is legally effective.
