Murder killer says he was scared of being shot

A gang prospect on trial in the High Court at Napier for murder says he was scared that the man he's accused of killing was going to shoot him.

Mark McCutcheon, 34, was fatally stabbed outside a hotel in Ongaonga in January last year, shortly after trying to stop a patched gang member from assaulting his girlfriend.

Hulio Ataria, 23, told the court he got in a tussle with Mr McCutcheon, who he says had taken a gun case out of his ute and was making threats to shoot people.

He said Mr McCutcheon showed no sign of being injured and drove away a short time later.
