A group occupying Aotea Square will have to wait to find out whether or not it is to be evicted from the central Auckland site.
Judge David Wilson, QC, reserved his decision on Friday, following a two-day hearing in the Auckland District Court.
Dozens of people have been camping in the square since the middle of October as part of a global protest against corporate greed that began with the Wall St protests in New York.
On 29 November, the Auckland Council issued a trespass notice and is seeking an order that would allow police to remove the protesters.
The defence, led by activist Penny Bright and lawyer Ron Mansfield, has argued that the group, Occupy Auckland, is entitled to be there under the Bill of Rights.
They say to move the protesters is pointless, because damage to the square's grass has already been done.
The council argues the impact of the protest on the public outweighs principles of free speech in the Bill of Rights.
Judge Wilson has not said when he will release his decision.
