Law Commission questions need for OIA agency

The Law Commission is questioning whether a Government agency needs to take responsibility for overseeing the Official Information Act.

It says the Official Information Act 1982 has made the Government more open and made the public more suspicious of any secret activity.

But departments can be overwhelmed by the volume and scope of some requests.

Employees can be diverted from their jobs for weeks to meet requests, even though they are not always justifiable.

The commission says the law is complicated by the digital revolution with official information now also contained in emails, tweets, text messages, blogs and digital video.

Although the Ombudsman hears complaints under the law, the commission says an agency such as the State Services Commission could be charged with being the Official Information watchdog.
