No charges over Auckland care home death

Police will not be laying charges over the death of a disabled man who died while in care on Auckland's North Shore.

The unnamed man died in 2013 at a care home operated by Creative Abilities.

Deputy Health and Disability Commissioner Rose Wall released a report in February in which she said both the home and the caregiver had breached the man's rights.

The caregiver did not put a pillow behind his head, he was later found struggling to breath and attempts to resuscitate him failed.

Detective Senior Sergeant Nadene Richmond said following a thorough investigation and comprehensive legal review, the decision had been made not to lay charges.

She said a range of factors were taken into account, including the required evidential tests.
