The Supreme Court has found the Office of the Treaty Settlement made a material mistake when it said Bay of Plenty iwi Ngāti Whakahemo's treaty claims have been fully resolved.
That decision led to Whārere Farms being sold without Ngāti Whakahemo having the opportunity to bid for it.
Despite this there are no plans for the Crown to reconsider the farm sale.
Iwi advisor Willie Te Aho said the iwi will push ahead with a claim regardless.
"The claim for resumption is on the basis that the CNI (Central North Island) report from the Waitangi Tribunal clearly indicated that lands in this exact situation as Whārere, are a breach of the treaty.
"Its now a case of whether or not the Waitangi Tribunal will exercise its powers to make a binding recommendation in relation to the return of this land."
Mr Te Aho said the iwi met with Micro Farms, the purchaser of the farm, when it was on the market and said the buyers went into the deal with their eyes wide open.
