Judge declares mistrial in Fiji murder case

A mistrial has been declared in a court case in Fiji involving a policeman and eight soldiers who allegedly killed a youth in Nadi.

The men are charged with one count of murder and four of assault occasioning actual bodily harm.

Sakiusa Rabaka is alleged to have been assaulted at a military training location about a month after the coup in December 2006. He died a few days later.

A High Court judge has ruled that the prosecution in the case failed to give notice to the defence about highly prejudicial evidence regarding uncharged acts.

The FijiLive news website says a new trial will now take place.
