The American Samoa Chief Justice, Michael Kruse, says the government needs to find out how a man who came to the territory on a 30-day permit four years ago was allowed to remain on island and become a drug seller.
Justice Kruse says either no one noticed, no one cared or somebody just looked the other way.
He says the territory has a real problem with drugs and it seems the people involved have more resources than the government has available to stop them.
Justice Kruse says Kaili Tualau, who has been sentenced to five years jail for drug possession, had entered the territory in June 2005 on a 30-day tourist permit and been allowed to stay indefinitely.
On a separate drug distribution charge the court imposed a 20-year sentence on Tualau which was suspended to 20 years probation.
