Maori Party MP Hone Harawira says the legislation replacing the Foreshore and Seabed Act is a sham and he will continue to fight against it.
The Tai Tokerau MP made a submission on the Marine and Coastal Area Bill to the Maori Affairs Select Committee at a hearing in Whangarei on Monday.
He told his fellow MPs the bill is racist, because it discriminates against Maori.
Mr Harawira says the bill is a fraud because although it restores the right of Maori to go to court to seek customary title, Maori groups will not be able to afford to do so.
He took a swipe at his caucus colleagues, saying the Maori Party was elected to fight legislation such as the marine bill.
He says the party's MPs were not elected to go soft, or meekly accept that which they know to be wrong.
In his submission, Mr Harawira says the bill is not what Maori marched for in 2004, and will not bring about a just or durable resolution.
He says the bill allows the Crown to determine what Maori customary title will be and reduces customary title to a lesser status than private title.
Mr Harawira is usually a member of the committee, but the Maori Party leadership replaced him with another MP while it considers the bill, saying committee members needed to have an open mind.
The Marine and Coastal Area Bill allows Maori to seek customary title to the foreshore, but only if they can prove exclusive and uninterrupted use of an area since 1840.
