The Labour Party has released its response to the Attorney-General over the proposed legislation on covert police surveillance.
In a letter, Labour MP Charles Chauvel acknowledges legislation is required to define the scope of police powers in that area but questions National's commitment to securing cross-party support.
He says Labour still has a number of unresolved questions about the need for urgency, making the legislation retrospective and whether there will be a select committee hearing.
Mr Chauvel says his party's support still depends largely on the having a select committee hearing.
A spokesperson from the office of Attorney-General Chris Finlayson says Cabinet will have to consider the bill and any other matters when it meets on Monday.
