The company charged in relation to the homicide of a security guard in Auckland is denying the allegation.
Charanpreet Dhaliwal died of head injuries after being assaulted in November.
It was the 22-year-old Indian migrant's first day on the job and a man has been charged with his murder.
The Department of Labour says CNE Security, which employed Mr Dhaliwal, has been charged with failing to provide a safe work environment.
The security company has pleaded not guilty.
