The Auckland Council is considering prosecuting businessman and property developer Donghua Liu for a second time under the Resource Management Act (RMA).
The council said Mr Liu may have destroyed a stone wall and cut down trees on the border of his Newmarket property without consent.
On Friday, council staff halted the excavation work on Gillies Avenue after they received a complaint from neigbours.
Heritage New Zealand said the wall was likely protected by the Heritage New Zealand Pouhere Taonga Act as it was probably built in the 19th century.
Last October, Mr Liu admitted council charges under the RMA and Building Act.
