New Cooks parliament may not sit before next year

The Cook Islands may have to wait until the new year before parliament sits as the Appeal court is yet to deliver its ruling on several electoral challenges.

Former solicitor-general, John McFadzien, says although parliament is required by the constitution to sit within 90 days after general elections, or by December 7th, it cannot do so until all electoral petitions are finalised.

He says the deadline may be looming but with no news from the Appeal court, there is likely to be further delay before parliament meets.

"There is one petition still on the books to be heard and that is in respect of the prime minister's constituency, the island of Manihiki but there's two appeals under consideration by the Court of Appeal at the moment, in respect of petitions that were initially struck out by the high court."

Mr McFadzien says the cases go back to the high court following the Appeal court's ruling on the point of law raised,
