Parveen Kumar Bala had been charged with dangerous driving causing the death of a man in Lautoka in 2013 but the magistrate's court acquitted him last month.
Mr Pryde told FBC News that his office accepts the central premise of the court that the state failed to prove that the manner of driving was dangerous in the circumstances.
He says therefore there will be no appeal.
