A final bid by Megaupload founder Kim Dotcom to obtain the FBI documents in the extradition case against him is not guaranteed a hearing in the Supreme Court.
The United States wants to extradite Mr Dotcom, a German national with New Zealand residency, and his three fellow accused to face charges of internet piracy, money laundering, racketeering and wire fraud.
The Court of Appeal on Friday ruled United States prosecutors are entitled to produce a summary of evidence against Kim Dotcom, rather than the detailed information.
On Friday Kim Dotcom tweeted that he would be taking his fight to New Zealand's highest court, the Supreme Court.
Mr Dotcom's New Zealand-based lawyer, Willie Akel, says they make a decision over an appeal in the next few days.
Intellectual property lawyer Matt Adams is following the case and said there is no automatic right of appeal to the Supreme Court, and the case's high-profile does not necessarily guarantee the case will be reviewed.
