Anzac Day crash survivor seeks court action

The sole survivor of an Air Force helicopter crash on Anzac Day 2010 is going to court on Wednesday in an effort to prosecute the Defence Force over the crash.

Sergeant Stevin Creeggan was seriously injured in the crash which claimed the lives of three of his colleagues, Flying Officer Daniel Gregory, Flight Lieutenant Hayden Madsen and Corporal Benjamin Carson.

His lawyers are to ask Wellington District Court for permission to proceed with a case under the Health and Safety in Employment legislation.

The court has to grant leave for the case to proceed because of the length of time that has passed since the crash occurred.

The judge is likely to reserve the decision.
