The legal representative for a man mistakenly shot and killed on an Auckland motorway says his family is suing police because officers were reckless.

Halatau Naitoko was driving the family business courier van when was killed by an armed offenders squad member in January last year.

Police were in pursuit of an armed man at the time.

The 17-year-old's death was the subject of a coroner's inquest in March and it will resume to hear further evidence on 20 December.

The Naitoko family's legal representative Colin Pidgeon, QC, says police recklessly fired five shots on the busy north-western motorway.

Mr Pidgeon says their action was excessive and Halatau Naitoko should not have died.
