A New Zealand man trying join a case against two former Khmer Rouge commanders he believes were involved in his brother's death has had his application rejected.
Rob Hamill's brother Kerry Hamill was killed in a prison in Phnom Penh in 1978 after the yacht he was on strayed into Cambodian waters.
Mr Hamill filed an application with a Cambodian court to join the case against the two commanders as a civil party.
He says the explanation given to him for his rejection is that he is not a victim.
Mr Hamill says he will appeal against the ruling as he says the court had previously accepted him as a victim.
Last year, a United Nations-backed tribunal convicted the prison chief, known as Comrade Duch, jailing him for 35 years for his part in the deaths of up to 15,000 people in the 1970s.
