Death case appeal fails

6:03 am on 21 May 2011

A South African couple convicted over the death of their baby daughter in Auckland, have failed to overturn their convictions and sentences in the Supreme Court.

Azees Mahomed was found guilty of murdering 11-week-old Tahani and sentenced to 17 years in prison.

His wife, Tabbbasum Mahomed, was convicted of failing to provide the necessaries of life and sentenced to four years prison.

The baby, who was severely malnourished, died of serious head injuries on New Year's Day in 2008.

The parents have always denied any knowledge regarding how the child came to harm.

The Supreme Court unanimously agreed the guilty verdicts were inevitable and dimissed the appeals.

They will be deported to South Africa once they have completed their sentences.
