Save Kapiti group seeks leave to appeal to Supreme Court

A group fighting to stop construction of the Kapiti expressway has sought leave to appeal to the Supreme Court.

The $630 million project was approved by a board of inquiry in April. An appeal to the High Court by the Save Kapiti group was dismissed on 19 August.

If leave is granted, the Supreme Court may hear the matter or it would be referred to the Court of Appeal.

Save Kapiti spokesperson Mark Harris said the group is attempting the appeal because it does not agree with the High Court's understanding of the group's previous appeal.

Ideally, he said, the Supreme Court overturn the Board of Inquiry's approval and the Transport Agency will have to scrap the project.
