Police accused of double standards over breath-test case

A lawyer who specialises in drink-driving cases has accused the police of double standards.

The head of police prosecutions, Superintendent Graham Thomas, has reportedly been removed from his position after refusing to take a breath test when officers came to his home in December.

Lawyer Chris Reid says the officer was within his rights to refuse the test, but the incident shows that the police are applying double standards, because they would expect a member of the public to co-operate when asked to take such a test.

The police will not confirm the identity or rank of the officer in question, who has been temporarily stood down from his job.

They are saying only that a police employee was under investigation and is now undertaking a period of medical rehabilitation for at least six months while working in an alternative role.

They say he was within his rights to decline a breath test.
