Court allows mother to continue dead son's appeal

The Court of Appeal has allowed a mother to continue with her dead son's appeal over a conviction for stealing Ngai Tahu greenstone.

In 2008, Morgan Saxton was jailed for two years and six months, while his father David was jailed for two years and nine months for stealing greenstone from South Westland.

The pair were also ordered to pay reparation of $300,000.

Both men filed appeals against their conviction and sentence and were released on bail.

Morgan Saxton died in a helicopter crash late last year before the appeal could be heard.

The Court of Appeal found that, because Morgan Saxton's mother has a continuing interest in the outcome of the appeal, she should be allowed to continue it on his behalf.
