The Commerce Commission says Air New Zealand is trying to delay proceedings that will look at whether the company was party to an international price fixing arrangement.
The commission has filed proceedings to determine whether Air New Zealand, some of its employees and 12 other airlines operating in New Zealand colluded over fuel surcharges in the air cargo industry.
Air New Zealand is now seeking a judicial review over what it says is a refusal by the commission to provide it with any evidence that it was involved in the air-freight price-fixing cartel.
The commission says it's disappointed Air New Zealand has filed what the airline itself describes as unnecessary litigation.
Air New Zealand says the papers were filed with the High Court on Thursday. It expects to obtain a court date within weeks.
