Judge opposes appeal for on-the-spot protection orders

The Principal Family Court judge has told MPs on Parliament's Justice Committee that there should be no right of appeal over on-the-spot protection orders for domestic violence.

Under the new legislation, police could issue on-the-spot orders where there are fears for the family's safety but not enough grounds for arrest.

The order means the violent person can be removed from contact with the family for up to five days.

Principal Family Court Judge Peter Boshier told MPs that if the perpetrator is given the right to appeal, the courts would be unable to cope.

He says if the law does contain the right to appeal, there is no point proceeding with the new kind of order.
