Court of Appeal upholds murder conviction

A Taranaki woman who drove for 13km with her former partner clinging to the bonnet of her car, has lost an appeal against her conviction for murder.

Cyndi Marcia Fairburn was convicted in 2007 after she drove her car, with her former partner on the bonnet, head-on into another car - killing him and seriously injuring herself and another person.

Fairburn appealed to the Court of Appeal on the grounds the trial judge wrongly prevented her from running a defence of self-defence and that the Crown counsel made inappropriate observations in her closing address to the jury.

The Court of Appeal has rejected both claims.

Fairburn had accused her former partner of sexually abusing their daughter.
